Terms and Conditions
Double Play GmbH, Jakob Wiemer, Wiesenweg 22, 38226 Salzgitter, Germany – for the online course "Double Play Growth Partner Framework"
1. Scope and Customer Base
1.1
These Terms and Conditions apply to all contracts regarding access to the online course "Double Play Growth Partner Framework" (the "Course") between Double Play GmbH (the "Provider") and the customer.
1.2
The Course is offered exclusively to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), i.e., natural or legal persons or partnerships with legal capacity who, when concluding the contract, act in the exercise of their commercial or independent professional activity (the "customer"). The Course is not intended for consumers within the meaning of Section 13 BGB. The Provider does not knowingly conclude contracts with consumers.
1.2
During the order process, the customer must enter their company name. By doing so, the customer confirms that they are purchasing the Course in the exercise of their commercial or independent professional activity. The Provider may request suitable supporting information (e.g., VAT identification number, website) and may decline orders where it is apparent that the purchase does not serve a business purpose.
2. Subject Matter of the Contract
2.1
The subject matter of the contract is the provision of a digital online course consisting of video lessons, templates, and accompanying materials on the topic of building and selling ongoing retainer-based service models for web design service providers.
2.2
The Course conveys knowledge and working materials. No specific economic outcome (e.g., revenue growth, client acquisition, higher pricing) is owed or guaranteed.
2.2
Access is provided via Memberspot and is activated upon receipt of payment.
2.3
As a token of appreciation to Early Access customers, the Provider intends to add further content (e.g., deep-dive modules, live Q&A sessions, community access) at no additional charge. This additional content is provided on a voluntary, best-effort basis; it does not form part of the paid Course under Section 2.1 and is not subject to a binding delivery date. Its provision, scope, and timing may change or be discontinued at the Provider's discretion.
3. Conclusion of Contract
3.1
The presentation of the Course on the website does not constitute a binding offer, but an invitation for the customer to place an order.
3.2
The contract is concluded when the customer completes the order process via the payment provider (Stripe) and the Provider accepts the order by activating access or by order confirmation via email.
4. Prices and Payment
4.1
The price stated at the time of order applies. Prices are displayed net of value-added tax. The applicable value-added tax – determined by the customer's country, tax status, and any VAT identification number provided – is calculated and shown at checkout before payment is completed.
4.2
Payment is made via the payment provider Stripe using the payment methods offered there. The purchase price is due immediately upon conclusion of the contract.
4.3
For payment processing, the Provider uses Stripe's "Managed Payments" service. Under this service, Stripe's affiliate Link, LLC acts as merchant of record and is the seller of record for the underlying sales transaction, including collection of the purchase price and the calculation, collection, and remittance of applicable sales tax, VAT, or GST. Link, LLC accordingly issues payment receipts and invoices in its own name. The provision of the Course itself – including access, content, support, and the guarantee under Section 7 – remains the responsibility of Double Play GmbH.
5. Access and Availability
5.1
Access to the Course is granted for an unlimited period.
5.1
The Provider endeavors to ensure continuous availability of the course platform. Brief interruptions due to maintenance, updates, or technical faults for which the Provider is not responsible do not give rise to any claims by the customer.
5.3
The Provider is entitled to update, expand, or restructure course content, provided that the essential character and scope of the Course is maintained.
6. Usage Rights
6.1
The customer receives a simple, non-transferable right to use the course content for their own business purposes.
6.2
Sharing access credentials, reproducing, publishing, or passing on course content to third parties, as well as using it to create the customer's own training offerings, is prohibited. The customer may use the templates included in the Course within their own business operations, including with their own clients.
6.3
In the event of violations of Section 6.2, the Provider is entitled to block access. Further claims remain unaffected.
7. Voluntary Money-Back Guarantee
7.1
In addition to any statutory rights, the Provider grants the customer a voluntary money-back guarantee: the customer may request a refund of the purchase price within 14 days of purchase.
7.2
The guarantee is subject to the following conditions:
100% of the course content must have been demonstrably viewed (progress is tracked automatically via the course platform).
Before the refund is granted, the customer must take part in a feedback call with the Provider (approx. 20-30 minutes). In this call, the customer describes which of the provided resources (e.g., the offer template, sales scripts, CRM) they applied and where, from their perspective, the implementation fell short. The period under Section 7.1 is met if the refund request is received within 14 days of purchase, regardless of when the call takes place. If the customer does not attend the call or declines it, the guarantee lapses.
7.3
The refund will be made via the original payment method within 14 days after the feedback call has taken place.
7.4
This guarantee does not limit any statutory rights that may apply.
8. No Statutory Right of Withdrawal
8.1
Since the Course is offered exclusively to entrepreneurs (Section 1.2), the customer has no statutory right of withdrawal.
8.2
This does not affect the voluntary money-back guarantee under Section 7.
